2.- Acceptance This website and the service provided (hereinafter the Service) is available to any user and is subject to the following terms and conditions: these Terms of Use and Sale, our Privacy Policy and Cookies Policy. When you use the Service, you accept our terms and conditions and thereby agree not to use the Service for illegal purposes. On the other hand, we inform you that for legal reasons we file the electronic documents in which the subscriptions to our payment services are formalized. 3.- Description of the Service 3.1.- Provision Through the Service you can register as a professional physiotherapist that offers your services to potential patients or use the Service for the management of your own patients, facilitating the follow-up of them. If your physiotherapist has invited you to the Service, use the username and password provided to identify you on the platform. If you use the Service as a professional, you must create your profile from the button called "New Professional", complete the requested information and add patients, their profiles, resources and exercise tables. If you use the Service as a potential patient, you must create your profile from the button "New patient", fill in the requested information and once inside you can search and contact the professional that you might interest in. 3.2.- Application The users, whether patients, potential patients or professionals, must agree to use the Service in accordance with current legislation and the terms and conditions of the platform. Similarly, the users agree not to collect data for advertising purposes, send advertising of any kind or communications for sale or other commercial purposes. Neither make available to third parties, for any purpose, the data collected in the Service. In case of non-compliance with these obligations, the users must be accountable to them. Likewise, in case of damaging, disable, overloading, deteriorating or blocking the normal use of the materials and information contained in the Service, the information systems or documents, files and all kinds of contents stored on any computer equipment of Hefora, of its members or any user of the Service.


4.- External links You may be sent from the Service to other websites through links. However, Hefora does not control those sites or their content that, in fact, are subject to their own terms and conditions. Therefore, Hefora is not responsible for the quality, veracity or accuracy of those sites.


5.- Age Regarding the registration in our Service, or the hiring any of our paid subscriptions, you declare that you are of legal age and that you have the necessary legal capacity to be bound by this agreement and use the site in accordance with its terms and conditions, which you understand and acknowledge in its whole. If you contract the Service on behalf of a company, you acknowledge having authorization and adequate representation on behalf of the organization to do so. You declare that all the information you provide to access the Service, before and during its use, is true, complete and accurate.


6.- Intellectual and industrial property The content and the information of this site (data, text, sound, pictures or code, among other), as well as the hardware and software used to provide the content and information are owned by Hefora or according to the corresponding licenses. 8.- Price and taxes The prices of the plans offered in Hefora are indicated in euros (€) and include the value added tax (VAT) applicable to these services in Spain. In case that the place of residence or domicile of the client is another member state of the European Union or a third state, the price of the reservation may be modified if the applicable tax rate is different.


9.- Payment To hire a subscription, it is essential to pay it fully in advance. The payment of the contracted Service can be made: ● By credit and debit card VISA or Mastercard, charging the amount of the price when you are purchasing the products. In this sense, Hefora informs holders of credit and debit cards that transactions in the online store are made in a secure payment gateway, using SSL technology to ensure security in the transmission of data.


10.- Validity of the offers The plans offered in the Service, and the prices of those, will be available for purchase while they are in the catalog displayed through the web. In any case, Hefora reserves the right to make the changes in the Service it deems appropriate, being able to update functions of the Service according to the market. The prices that appear on the web are indicative. Hefora reserves the right to change prices without prior notice. We inform you that in spite of the updates that are made to the prices of the Service, these could contain errors. We will promptly correct all errors that appear, but will not be binding on the Service.


11.- Professional qualification Hefora will not intervene in any case in the negotiations carried out between a potential patient and a professional, staying out from them, so it will not be responsible, in any case, for compliance with the obligations from one party with another. Therefore, patients, potential patients and professionals exempt Hefora from any disagreement that may arise between them. It is the sole responsibility of the patient or potential patient to verify the suitability of the services offered by the professional, and that they are adapted to their needs. The patient or potential patient also assumes the responsibility of examining the qualification, training and competence of the professional, as well as carrying out the appropriate follow-up on the services required, the indicated exercises, the resources provided and the adequacy to what is requested by the patient or potential Patient and agreed between the parties. In no case Hefora will control or intervene in the execution of the tasks and services offered by the professional, nor in the adequacy, quality or result of them, nor in the payment obligations derived from them. Therefore, Hefora excludes, to the fullest extent permitted by law, any liability for damages of any kind caused due to the execution or result of the work entrusted to the professional. In turn, the patient or potential patient expressly exempts Hefora from any discrepancy, liability, damage, prejudice or impairment as a result of hiring or work performed by the professional.


12.- Exclusion of guarantees and responsibility Except in those cases expressly described in these terms and conditions and to the extent permitted by law, Hefora is not responsible for damages of any kind due to lack of accuracy, completeness or timeliness, including errors and omissions, of the information contained in the Service. Likewise, neither of any duty or commitment to verify or monitor its contents and informations. Likewise, Hefora does not guarantee the availability and continuity of the operation of the Services. Hefora will endeavor to warn well in advance of any interruptions that may occur in the operation of the Service whenever possible. Hefora excludes, to the fullest extent permitted by the legal system, any liability for damages of any kind due to lack of availability or continuity of the operation of the Service. Similarly, regarding the fraud of the utility that users could have attributed to the Service. In addition, Hefora excludes any liability for damages of any kind that could happen due to the use of the Service and its contents by users, patients or professionals, or that are resulted from the lack of veracity, validity or authenticity with the information about themselves that users provide to others. In particular, Hefora excludes any liability for damages of any nature that are caused due to the impersonation of a third party made by a user in any kind of communication made through the Service.


13.- Cancellations The plans that require the payment of a subscription, to facilitate the search for professionals, can be canceled at any time, even before the end of the contracted period. But Hefora will not refund the amounts that have already been paid. While your plan is active, Hefora will provide the contracted services. 14.- Modifications and nullity We may update the terms and conditions of the Service in the future, as well as its characteristics and functions. However, this will not negatively affect the quality of any specific service that we have expressly agreed to provide. We will inform you of the changes in terms and conditions by placing a notice in a prominent place on our website and / or by email. If any clause included in our terms and conditions is declared, totally or partially, null or ineffective, the same will only affect that provision or the part of it that is null or ineffective. The terms and conditions will remain in everything else, having such a provision, or the part of it that is affected, by not setting.

In this sense, and according to the applicable regulations, Hefora informs about the existence of a European online dispute resolution platform that facilitates the extrajudicial resolution of such litigation for contracts also concluded online between consumers and Internet service providers.
